The implementation of the European Parliament’s MCP Directive, which was approved by the Polish Parliament in an amendment to the “Environmental Protection Law”, covers more than 5,000 towns. It applies to energy production installations with a capacity of more than 1MW and less than 50MW.
The presumed restrictions on emissions of certain pollutants into the air from medium-sized combustion plants (“MCPs”) became effective on November 27, 2017.
The MCP Directive, as implemented, sets new lower limits for emissions of SO2, NOx and dust into the air, differentiating these limits depending on the type of installation and the type of fuel used in an existing or newly commissioned system.
The Directive will be implemented according to the following schedule:
- Beginning December 20, 2018. – for new MCPs
- Starting from 1 January 2025 – beginning on December 20, 2018 in relation to existing MCPs with thermal capacity greater than 5 MW and less than 50 MW
- Starting from January 1, 2030 – With respect to existing MCPs with a thermal capacity of less than 5 MW.
